BARTOW, Fla. (FOX 13) - Polk County Sheriff's Office detectives are looking for a gunman who fatally shot a man over the weekend. Sheriff Grady Judd said it could have actually been a 'stand your ground' case.
Investigators are looking for Joshua Pacheco, who they say shot and killed Julian Garcia after a bizarre series of events.
Investigators say Garcia, who lives in Apopka, was visiting his family in Bartow. They say he was not getting along with his mom, so his sister took him to the Citgo Food Market, on Highway 17 near Bomber Road, to calm down.
Surveillance video shows Garcia in the parking lot, talking to his sister. Then, for unknown reasons, he starts backing away.
“He sees Joshua Pacheco, who is now standing near the road, ostensibly waiting for a ride to pick him up,” explained Polk Sheriff Grady Judd.
Judd says Garcia chased Pacheco behind what appears to be a dumpster. They two men fought, falling on the ground.
Investigators say that's when Pacheco pulls out a gun and fatally shoots Garcia in the stomach.
Detectives can’t understand why Garcia became aggressive with Pacheco.
“He ran out there and apparently jumped on a guy who was minding his own business. At least that’s what the investigation tells us so far,” Judd told FOX 13.
Pacheco took off down Bomber Road and may have jumped into a red truck to get away.
Judd says, because Pacheco is a felon, he should not have been carrying a gun and could face charges because he did.
He suspects that Pacheco took off because he was afraid he was going to be charged with murder.
Judd said, by what investigators know now, that’s not likely to happen, but they need to hear his side of the story first.
If anyone knows anything about the shooting or the whereabouts of Pacheco, the Polk Sheriff’s Office would like to get a call.
