Accused kidnapper claims mistreatment in jail
TAMPA (FOX 13) - Defendant Trevor Summers says he's being mistreated in jail and now he wants a judge to do something about it.
His attorney, Julian Hayes told the judge Wednesday his client's treatment by jailhouse guards was "cruel and unusual."
Hayes says jailed mass murderers are receiving better treatment.
"He is being sequestered. He's being shackled. None of that is justified. There has been no violent acts, whatsoever," Hayes told the judge.
Summers is accused of planning a murder-suicide in early 2017. Prosecutors say he kidnapped and sexually assaulted his estranged wife, but she was rescued before he could carry out his plan.
Summers ended up in jail but is accused of continuing his erratic behavior. A judge barred from having any contact with his wife and their kids, but he did it anyway.
Prosecutors say he was quietly writing letters to his children and then sneaking them to his parents so they could hand deliver them.
As for Summers' supposed mistreatment, Judge Mark Kiser said, "that is not an issue I'm going to get involved with."
Hayes says he will seek a court order to force detention deputies to change their behavior with Summers.
