Sheriff wants strict punishment for man accused in hit-and-run that ended woman's pregnancy

DAVENPORT, Fla. (FOX 13) - A man living in the country illegally is accused of causing a crash that killed an unborn child. He could be facing up to 20 years in prison, but if Polk Sheriff Grady Judd gets his way, the penalty could be a lot stiffer.

Bionel Cervin-Gomez is charged with leaving the scene of an accident and driving without a license, which means he could be sentenced to up to two decades in prison.

Vehicular manslaughter carries a maximum of 30 years behind bars. Judd would like to see him charged with that.

“They are researching the law to see if the law will do that,” said Judd. “Quite frankly, if it doesn’t provide for it, then I am going to approach the legislature and go: ‘If the child is viable, what he has done, is that he has killed the baby.’”

Two weeks ago, Cervin-Gomez allegedly turned in front of a 22-year-old woman in Davenport. She was coming back home after spending the day in Orlando with her family.

After the crash, Cervin-Gomez took off. After being on the lamb for a week and a half he was finally caught this past weekend.

The crash caused the woman to lose her unborn child, eight months into her pregnancy.

Even though the charges against Cervin-Gomez are still unknown, one thing is clear: After being prosecuted, it is likely that he will be deported back to Mexico for a second time.

He came here illegally in 2000, was deported, and snuck back into the U.S. again.
